Terms of Service

Atelier is a software service that generates on-model imagery and wholesale linesheets from the product packshots and data you provide. By creating an account you agree to these terms.

Atelier is available to businesses (Unternehmer, § 14 BGB) and to individual creators, including consumers (Verbraucher, § 13 BGB). Where you contract as a consumer, the statutory right of withdrawal in section 7 applies.

You are responsible for your account, your team's access, and keeping your credentials secure. You must be authorised to act for the brand you represent.

You retain all rights to the packshots, brand assets and data you upload. You grant us the limited licence needed to process them to provide the service (including sending them to our AI processor to generate images). You own the generated images for your commercial use, and you are responsible for holding the rights to everything you upload.

Don't use Atelier to infringe others' rights, generate unlawful content, or misrepresent products. We may suspend accounts that breach these terms or put the service at risk.

Paid plans include a render allowance ("credits") pooled across your brands. Prices are shown in euro (EUR), net of statutory VAT (USt.) unless stated otherwise; VAT is added at checkout where applicable, and EU businesses that provide a valid VAT-ID are billed under the reverse-charge procedure. Customers outside the EU may be charged in their local currency at checkout. Fees are billed in advance per the plan you choose; upgrades are prorated. Credits are consumed as you generate and do not constitute money or stored value.

Subscription fees and one-time credit purchases are non-refundable except where required by law, and credits are non-refundable once granted. If a payment is refunded, reversed, or charged back, we may revoke the corresponding unused credits and suspend generation until the balance is settled.

Because Atelier is a digital service that is made available immediately, where you are a consumer you expressly consent, on purchase, to us beginning performance before the withdrawal period ends, and you acknowledge that you thereby lose your right of withdrawal once performance has begun (see section 7).

You can cancel anytime; access continues to the end of the paid period. We don't provide refunds for partial periods unless required by law.

The following applies only if you contract as a consumer (Verbraucher). Businesses (Unternehmer) have no right of withdrawal.

Widerrufsbelehrung. Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsschlusses. Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Florian Wasmeier, Thannöd 18, 84371 Triftern, Germany, hello@gowiththeflow.io) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs. Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf bei uns eingegangen ist.

Vorzeitiges Erlöschen. Das Widerrufsrecht erlischt bei einem Vertrag zur Bereitstellung digitaler Inhalte oder digitaler Dienstleistungen vorzeitig, wenn wir mit der Ausführung begonnen haben, nachdem Sie ausdrücklich zugestimmt haben, dass wir vor Ablauf der Widerrufsfrist mit der Ausführung beginnen, und Sie Ihre Kenntnis davon bestätigt haben, dass Sie durch Ihre Zustimmung mit Beginn der Ausführung Ihr Widerrufsrecht verlieren (§ 356 Abs. 4 und 5 BGB).

The service is provided "as is." We work to keep it available and accurate but don't warrant uninterrupted operation. To the extent permitted by law, our liability is limited to the fees you paid in the preceding 12 months; nothing here limits liability that cannot be limited by law.

We may update these terms; material changes will be notified. These terms are governed by German law, with jurisdiction at the seat of Florian Wasmeier, unless mandatory consumer rules provide otherwise. Questions: hello@gowiththeflow.io.
